摘　　要：应急征用是行政征用的一种,但因突发事件应急处置的紧急性,其具体制度的设计又与其他征用有所不同。法律对行政征用的规定有所缺失,对应急征用的专门规定更是极为匮乏,因而应急征用制度中目前存在应急征用主体的规定与现实状况不符合、应急征用的法定程序不明确、补偿标准和补偿方式不完善等问题。相关法律需要对应急征用制度所存在的问题加以改正:在应急征用主体方面,应赋予应急管理部、其他应急管理机关及特定条件下的社会应急力量以必要的应急征用权;在应急征用程序方面,应对应急征用决定的作出、告知被征用人相关事项、对被征用财产进行价值评估、财产的归还、补偿金额的确定及补偿给付等必要程序作出完善的规定;在补偿标准与补偿方式方面,应明确公平补偿与结合被征用人实际需要进行补偿的原则。Emergency requisition is a kind of administrative requisition.However,due to the urgency of emergency response,the design of its specific system is different from other expropriation.The law has some provisions for administrative requisition,and the special provisions for emergency requisition are extremely scarce.Therefore,the current provisions on emergency requisition in the emergency requisition system are not in line with the actual situation,the statutory procedures for emergency requisition are not clear,and the compensation standards and problems such as imperfect compensation methods.Relevant laws need to correct the problems existing in the emergency requisition system.In the aspect of emergency requisition,the emergency management department,other emergency management agencies and social emergency forces under specific conditions should be given the necessary emergency requisition rights;In accordance with the provisions of the decision on emergency requisition,the matter related to the requisitioned person,the value assessment of the requisitioned property,the return of the property,the determination of the compensation amount and the compensation payment,etc.;in terms of compensation standards and compensation methods,the principle of fair compensation and the actual need to compensate for the requisitioned person should be clarified.
