监察留置措施的适用条件论析

摘　　要：在国家监察体制改革的背景下,《监察法》首次规定了“留置”措施,以“留置”取代“双规”措施,实现了法治反腐的跨越式发展。鉴于监察留置措施是对被调查人的基本权利的限制,《监察法》对监察留置措施规定了严格的适用条件,包括适用留置措施的对象要件、证据要件、情节要件和程序要件。尽管如此,监察留置措施的适用条件在实践中仍然面临诸多亟待解决的难题。完善监察留置措施的适用条件,需要从以下几个方面着力进行:制定配套的国家法律、赋予国家监察委员会以相应的法律解释权、完善监察留置措施的批准程序以及监察留置措施的相关配套机制等。Under the background of the reform of the national supervision system,the Supervision Law for the first time stipulates the“supervision detention”measure,replacing the“double regulation detention”measure,thus realizing the leapfrog development of anti-corruption under rule of law.In view of the fact that the supervision detention measure is a restriction on the basic rights of the investigated person,the Supervision Law provides strict applicable conditions for the supervision detention measure,including the object elements,evidence elements,plot elements and procedural elements of applying the lien measure.Nevertheless,there are still many problems to be solved urgently in practice.The improvement of the applicable conditions of the supervision detention measures needs to be carry out the following aspects:formulating the supporting national laws,giving the national supervisory commission the corresponding power of legal interpretation,perfecting the granting procedures of the supervision detention measure,and perfecting the Relevant supporting mechanisms of the supervision detention measure.
