摘 要:个人信息法律保护在大数据时代下涌现出许多新的问题。传统理论将信息视为商品,或者依靠合同契约来维系个人信息保护的信任度。大数据时代下将个人信息保护规制公法化,这构成了信托义务关系的法理基础。自此,信托义务规则框架的建构对信息时代中个人隐私权的保护大有裨益。In the era of big data,many new problems have emerged in the legal protection of personal information.In traditional theories,information is treated as a commodity or trust in the protection of personal information is maintained by contracts. While in the era of big data,it is regulated by public law,which constitutes the legal basis of fiduciary obligation relationship. Since then,the construction of the framework of fiduciary duty rules is of great benefit to the protection of personal privacy in the information age.
