摘 要:文章围绕疫情性质、疫情施工承包合同产生的影响及其应对,提出了10个问题:疫情原因可否解除施工承包合同;疫情后签订的补充协议是否一定有效;疫情的停工时间是否一定可顺延;疫情导致的费用和损失如何理解;延迟开工承包人额外费用有哪些;因疫情而延迟开工是否一定免除责任;不可抗力与情势变更的区别何在;如何评价和正确适用各指导意见;疫情停工属于不可抗说法是否严谨;疫情延迟开工责任是否一定是承包人;文章在对合同解除、不可抗力、工期延迟等一系列概念进行理论阐述的基础上,结合相关法律条款,通过问答形式对上述在新冠疫情下可能出现或已经出现的问题进行简析和答复,并提出现今疫情事件下对于不可抗力条款的适用是为了减轻突发事件下双方损失,而非仅为维护一方权益。The paper has proposed ten questions aiming at the nature of the epidemic, the influence of the epidemic construction contract and the response response, respectively including the follows: can the construction contract be terminated due to epidemic causes;is the supplementary agreement signed after the outbreak effective;can the shutdown time of the outbreak be extended;How to understand the cost and loss of the outbreak;What are the extra charges for the contractor due to construction delay;Can the contractor be exempt from liability for the construction delay due to the outbreak;What is the difference between force majeure and change of circumstances;How to evaluate and correctly apply the guidelines;the outbreak shutdown belongs to force majeure, it is rigorous;Is the contractor responsible for the construction delay due to the outbreak. The author describes the theory about termination of the contract, force majeure, time delay, etc. On the basis, relevant legal provisions are combined, the above-mentioned possible or existing problems under COVID-19 are briefly analyzed and replied through question-answer modes. It is pointed out that the the force majeure clause under current situation is applied to reduce losses under the emergency rather than protecting rights and interests of one party.
