摘　　要：授权暂时调整(停止)法律适用在新片区的立法中授权主体、被授权主体、授权方式、特定事项、授权期限、调整空间、调整幅度等内容需要进一步明确。中国(上海)自贸试验区新片区"参照"经济特区授权立法,也即"参照"经济特区管理,获得经济特区授权立法。新片区的立法路径有:授权暂时调整(停止)法律适用;参照经济特区授权立法。应充分利用上述立法路径。首先,利用授权暂时调整方法,将新片区总体方案规定的所有改革措施涉及法律调整的规定,由全国人大及其常委会授权国务院、最高人民法院等进行调整,并适时争取上海市人大及其常委会获得授权。其次,请求全国人大根据新片区主体方案赋予新片区经济特区授权立法。最后,上海市人大及其常委会充分利用相关立法路径修订《中国(上海)自由贸易试验区条例》与颁布《中国(上海)自由贸易试验区新片区条例》,作为新片区运行的"基本法"。There is a need for the authorization to temporary adjustment or suspension the application of the law to be further clarified in the Special Area of China(Shanghai)Pilot Free Trade Zone( "Special Area a"), specifically, in the contents of empowering subjects, authorized subjects, authorization ways, specific matters, authorization period, adjustment of spaces and adjustment of ranges. The Special Area "refers to" the authorized legislation in the Special Economic Zone, which means the Special Area references the management in the Special Economic Zone, adopting the authorized legislation way. There are kinds of legislative approaches in the New Area: authorization to temporary adjustment or suspension the application of law, reference to the authorized legislation in the Special Economic Zone and Shanghai Municipal People’s Congress and its Standing Committee’s legislation by authority power. In addition, the some above legislative paths should be made full use of. Firstly, under the authorized temporary adjustment way, the National People’s Congress and its Standing Committee authorize the State Council and the Supreme People’s Court to make adjustments on the reform measures in the Framework Plan for the Special Area which involves the existing law and regulation amendment,and the Shanghai People’s Congress and its Standing Committee should be striving to become the authorized subjects in due course. Secondly, the National People’s Congress empowers the Special Area with authorized legislation way in the Special Economic Zone according to the Framework Plan for the New Area. Lastly, the Shanghai People’s Congress and its Standing Committee make full use of relevant legislative approach to amend the "China(Shanghai) Pilot Free Trade Zone Regulation" and promulgate the "Regulation on the Special Area of China(Shanghai) Pilot Free Trade Zone " as the "basic law" during the operation of the New Area.
