论律师调解市场化的可行性及其建构

摘　　要：律师调解的市场化可作为“大调解”格局下完善人民调解、行政调解、司法调解联动工作体系的推手,实现帕累托最优。律师调解市场化的构建,可以借助于国家宏观调控与市场自由之间的适度干预。市场准入方面,实现执业伦理、回避、利益冲突禁止规则的规范化,配套司法监督、社会监督与行业自律体系。市场结构与载体上,以商品、供给与需求的要素优化为基础,运用ODR与律师调解耦合的“湖北经验”搭建市场化平台。市场运行方面,加强商事领域为重点趋势的律师行业化调解,借鉴临时仲裁进行律师调解的灵活化规则创设、设置瑕疵调解协议救济机制、完善律师调解员的执业保险制度,实现市场化律师调解的高效、自洽运行,并成为社会治理创新的重要构成部分。The marketization of lawyers mediation can be considered as a promoter to improve the working system of people s mediation,administrative mediation,and judicial mediation under the“major mediation”pattern,and achieve Pareto optimality.The construction of lawyers mediation marketization can rely on the appropriate intervention between state macro-control and market freedom.In terms of market access,we will standardize the rules of practice ethics,avoidance,and conflicts of interest,and support judicial supervision,social supervision,and industry self-regulation.As for the market structure and carrier,based on the optimization of the elements of goods,supply and demand,the“Hubei Experience”coupled with ODR and lawyer mediation is used to build a market-oriented platform.As for the market operation,we will strengthen the legalization of lawyers industrialization in key areas of commercial affairs,create flexible rules for lawyers mediation based on ad hoc arbitration,set up a mechanism for remedy for defective mediation agreements,and improve the practice insurance system for lawyers mediators.The efficient and self-consistent operation of it comes with an important part of social management innovation.
