执行和解现实困境与出路探寻——基于“公证参与司法辅助事务”武汉楚信公证处、成都律政公证处试点调研

摘　　要：执行和解协议签订,被执行人不履行致使纠纷再次回炉,亦或是多次变更和解协议履行期限、次数,致使执行案件无法结案。判决并不直接解决纠纷,实践中执行和解程序仍面临着不少困境,包括执行外和解协议的风险问题、以物抵债协议问题、和解协议中担保条款问题、被执行人迟延履行问题等。阐述“公证参与司法辅助”试点工作调研现状。从客观范围一致性、公证职能中立性、“公证参与执行和解”之辅助性三个维度,分析公证参与执行和解可行性。最后,以事前法律风险规制和事后纠纷解决对策为出发点,论证“公证参与”应对执行和解现实困境的有效对策,包括法律风险提示、财产线索核实、缩短诉讼周期、避免二次诉讼。When the reconciliation agreement of execute program is signed,the dispute will be returned if the executed person fails to perform the agreement,or the performance deadline and times of reconciliation agreement are changed,so that the execution case cannot be terminated.Judgment does not directly resolve disputes,the procedures of reconciliation of civil enforcement still face a lot of difficulties in practice,for example,there are risks in reconciliation agreement out of the civil enforcement;the issue of the agreement to pay debts with goods;problems with the guarantee clause in the reconciliation of civil enforcement;the executed person may delay the performance.To describe the current research status of the pilot work on“notarization in auxiliary judicial affairs”.Analyze the feasibility of notarization to participate in the reconciliation of civil enforcement from three dimensions:the consistency of objective scope,the neutrality of the notarization function,and the“notarization to participate in reconciliation of civil enforcement”.Finally,taking the legal risk regulation beforehand and the dispute resolution measures afterwards as the starting point,it demonstrates the effective countermeasures of notarization participation in reconciliation of civil enforcement,including legal risk warnings,verification of property clues,shortening the litigation cycle,and avoiding secondary litigation.
