摘　　要：监察权行使过程中造成侵害的应当承担赔偿责任,这是规范与制约监察权行使的需要,是保护被监察人合法权益的需要,也是监察法律体系进一步完善的需要。由于监察权及其侵害情形的特殊性,必须单独构建监察赔偿制度。在监察赔偿制度构建中,必须明确监察赔偿主体、赔偿范围、赔偿程序。在赔偿归责原则、赔偿方式、赔偿计算标准、立法体例等方面要与国家赔偿法相衔接。The infringement caused by the supervisory power should be liable for compensation,which is the need of standardizing and restricting the exercise of the supervisory power,the need of protecting the legal rights and interests of the supervised,and the need of perfecting the legal system of supervision.The supervisory compensation system must be constructed separately because of the particularity of the supervisory power and its infringement.The subject,scope and procedure of supervisory compensation must be clearly stipulated in the supervisory compensation system.At the same time,the principles of liability fixation,compensation methods,compensation calculation standards,and legislative style should be connected with the State Compensation Act.
