我国探矿权审批登记特征、存在问题与改革建议

摘　　要：矿业为我国经济建设提供主要的能源和原材料,是我国经济社会发展的支撑和保障,因此加强矿政管理,维护矿业高效发展非常重要。本文对我国探矿权的审批登记管理开展研究,重点从探矿权出让制度发展、分级审批与分类出让、行政许可事项以及审批登记现状等4个方面总结当前探矿权审批登记管理特征。在此基础上进一步分析探矿权审批登记管理中存在的问题,指出探矿权的审批权限、出让方式、许可证有效期、勘查阶段与缩减面积、重叠设置以及审批登记效率等6个方面的突出问题。针对上述问题,提出6个方面的改革建议,包括落实国家改革要求、加快矿法及配套法规修订、完善出让制度建设、优化审批登记工作、加快信息化网络建设和加快地勘行业信用体系建设。不断推进矿政管理改革解决探矿权审批登记中存在的突出问题,有助于进一步促进矿业高效发展。Mining industry provides energy and raw materials for economic construction and is the support and guarantee of national economic in China.Therefore,it is very important to strengthen the management of mining rights and maintain efficient development of mining industry.This paper studies the examination and registration of prospecting rights in China,and summarizes the characteristics of the management of examination and registration of prospecting rights in four respects including the development of prospecting rights transfer system,classified examination and categorized transfer,administrative license items and the current situation of examination and registration.On this basis,the problems existing in the management of examination and registration of prospecting rights are further analyzed,and six conspicuous problems are raised such as the authority of examination,transfer methods,license validity period,prospecting stage with reducing area,overlapping of prospecting scope and efficiency of examination and registration.In view of the above mentioned problems,this paper puts forward reform suggestions in six aspects,which include implementing the national reform requirements,speeding up the revision of mining law and related regulations,improving and perfecting mining right transfer system,optimizing the examination and registration work,strengthening construction of information network and credit system of geological prospecting industry.Continuously promoting the reform of mining administration can solve the prominent problems of examination and registration of prospecting rights,and it is helpful to further promote the efficient development of mining industry.
