社会自治组织概念探析

摘　　要：社会自治并非国家法治的绝然对立,社群意义上的社会自治应当获得必要的法治关怀。社会自治组织,是由社会成员自愿组成,在特定领域内向其成员履行公共职能,按照其章程展开活动的正式性组织。社会自治组织具有自生成性、互益性、自律性和合法律性等基本特征,它有别于非政府组织、非营利组织、市场中介组织、准政府组织等。按成员联结纽带、地域覆盖范围、自治程度等标准可以对社会自治组织进行相应的类型划分。其中,依自治程度的类型划分对社会自治组织相关法律问题的研究具有重要意义。在行政法和行政诉讼法上,符合一定条件的社会自治组织应当被赋予独立的法律主体地位。Social autonomy is not an opposite of the state ruling by law.Social autonomy in the sense of community deserves the care of the modern rules of law.Social autonomy organization is a formal organization which is organized by members of a society of their own will,performs its public functions in a specific field for their members and carries out activities according to its constitution.The social autonomy organization has the basic characteristics of self-generation,mutual-benefit,self-discipline and legality,which may distinguish it from non-government organization,non-profit organization,market intermediary organization and quasi-governmental organization,etc.Social autonomy organizations can be classified into different categories according to its connection of members,areas of members and the autonomy degree of organizations.It is of great significance for the study of relevant legal issues concerning social autonomy organization to classify it according to the types of the degree of autonomy.Social autonomy organization that conform to certain requirements are supposed to be seen independent legal subject in terms of administrative law and administrative litigation law.
