国家治理现代化背景下政府特许经营法律理论研究

摘　　要：政府特许经营,在关于特许经营权、转让或特许经营的过程中存在诸多风险,因此有必要在风险到来之前对其进行规避、转移或分散,并针对其制定切实可行的合理措施,做到尽可能覆盖全面的风险防范。且风险防范措施的是否完善将直接影响政府特许经营项目的运行,甚至于危及项目投资者的预期收益。近年来,大型基础设施建设在数量和质量上都取得了重大突破,但相关基础设施建设管理部门的财政负担也在不断增加。党的十九大四中全会提出,全面完善国家治理体系,推进国家治理能力现代化,充分体现中国特色社会主义制度优越性,缓解财政压力,提高经济效益,解决实际困难。政府特许经营的公私合作模式已被引入我国重大公共建设项目。因此,针对特许经营的性质、规制及法律规制等问题,值得深入研究和探讨。Government franchise has many risks in the process of franchise rights,transfer or franchise,so it is necessary to avoid,transfer or diversify the risks before they come,and develop practical and reasonable measures for them.Achieve as much comprehensive risk prevention as possible.In addition,the improvement of risk prevention measures will directly affect the operation of government franchise projects,and even endanger the expected returns of project investors.In recent years,large-scale infrastructure construction has made major breakthroughs in both quantity and quality,but the financial burden of related infrastructure construction management departments has also increased.The Fourth Plenary Session of the 19th National Congress of the Communist Party of China proposes to comprehensively improve the national governance system,advance the modernization of national governance capabilities,fully reflect the superiority of the socialist system with Chinese characteristics,ease financial pressure,improve economic efficiency,and solve practical difficulties.Therefore,the public-private cooperation model of government franchise has been introduced into China's major public construction projects.Therefore,in view of the nature,regulation and legal regulation of franchising,it is worth in-depth research and discussion.
