JCT与FIDIC设计-建造合同条件中支付管理的比较分析

摘　　要：支付问题是项目管理的核心问题之一,影响到项目的费用、工期、现金流等方面的正常运转。作为目前被广泛使用的合同条款、JCT条款和FIDIC条款对于支付问题都有详细的规定。然而,在2016—2017年JCT和FIDIC条款相继更新后,目前学界对于这2个新版合同条款的研究及其对比分析却较少。选取了设计-建造(Design-Build)合同模式,针对其支付问题,以这2个合同范本作实例并进行对比分析。Payment issue is one of the core issues of project management,which affects project cost,schedule,cash flow and other aspects.As the widely used contract terms,JCT terms and FIDIC terms have detailed provisions on payment management.However,after the JCT and FIDIC terms were updated successively in 2016 and 2017,there are few studies and comparative analysis on the two new versions.Aiming at the payment issues,this paper selects the Design-Build contract mode to perform comparative analysis based on these two contract terms.
