摘　　要：Cookie技术在网络活动中便利与风险并存,技术滥用极易侵害公民个人信息权益。对Cookie技术滥用行为的规制重点在于对Cookie信息的强化保护,然而我国当前对Cookie信息的法律保护尚存困境,理论上Cookie信息规范属性模糊,实践中民行规制乏力、刑法适用存弊。构建完善的Cookie技术法律规制体系,需将Cookie信息纳入个人信息之范畴,明晰网络用户享有的各项基本信息权利,对数据活动设置豁免机制,并完善相应的法律救济方式。Cookie technology is convenient and risky in network activities,and technology abuse is easy to infringe citizens’personal information rights.The regulation of Cookie technology abuse focuses on strengthening the protection of Cookie information.However,the legal protection of Cookie information in China is still in a dilemma.In theory,the attribute of Cookie information norms is vague.In practice,the civil and administrative regulation is weak,while the application of criminal law has disadvantages.To build a perfect legal regulation system of Cookie technology,it is necessary to incorporate Cookie information into the scope of personal information,clarify the basic information rights enjoyed by network users,set up an exemption mechanism for data activities,and improve the corresponding legal remedies.
