摘　　要：经济全球化使得文化多样性受到威胁,在此背景下,各国都努力保持本国文化独特性,并以此推动本国文化创意产业的发展。作为文化创意产业重要组成部分的博物馆,其所拥有的馆藏文物正是发展创意产业的重要资源之一。近年来,我国博物馆在文创产品研发方面进步明显,但由于相关法律规定不完善和博物馆知识产权保护意识不足等原因,博物馆文创衍生品的知识产权保护还存在一些问题。基于对博物馆文创衍生品知识产权保护现状的梳理,分析我国博物馆在文创衍生品知识产权保护过程中的困境,并提出博物馆文创衍生品知识产权保护的具体建议。In today’s world, economic globalization is booming and cultural diversity is threatened. All countries are actively looking for the uniqueness of their own cultures to develop culturally creative industries which are to develop their own culture and promote economic development. Museums are inevitably playing an important part in the culturally creative industries. They have a rich collection of cultural relics which is the capital of creative industry. Although museums have many excellent culturally creative derivatives in the research and development of cultural products, there are still some problems in the protection of intellectual property rights of the culturally creative derivatives of the museums due to the lack of legal provisions and the weak awareness of intellectual property rights of the museums. This paper analyzes the current situation of the intellectual property rights of the culturally creative derivatives of the museum, the disputes and legal dilemmas encountered by the Chinese museums in the intellectual property protection of the culturally creative derivatives, including the subject qualification dispute and the protection mode of intellectual property rights. Finally, this paper puts forward some suggestions for the protection of intellectual property rights of the culturally creative derivatives of the museum.
