摘 要:2019年7月,张扣扣案终审引起舆论对复仇正当性的讨论。复仇在中国的法制史上占据重要席位,并深刻影响着当代中国法治的建设和发展。复仇以儒家礼教伦理为依托,具有正当性。随着社会和经济结构的转变,复仇制度已经不为当代法律所认可,但是社会上的暴力复仇事件仍然屡见不鲜,归根结底是因为国家公力救济不完善,案结事未了,受害人才会采用私力救济手段。因此为避免暴力复仇频发,国家应当进一步完善公力救济,在不断培养民众的法治思维的同时,要建立公正有效的法治体系。The final trial of the zhangKoukou case in July 2019 has aroused public opinion to discuss the legitimacy of revenge. Revenge has always occupied an important place in China’s legal history, and deeply influenced the construction and development of the rule of law in contemporary China. Revenge is based on Confucian ethics and has legitimacy. But with the change of social and economic structure, the system of revenge is no longer recognized by contemporary law. However, violent revenge incidents in the society are still common. In the final analysis, it is because the public relief of the state is not perfect and the case is not settled that the victims will resort to private relief measures. Therefore, in order to avoid the frequent occurrence of violent revenge, the state should further improve public relief, continuously cultivate people’s legal thinking, and most importantly establish a fair and effective legal system.
