竞技体育致害行为正当化评价机制构建研究

摘　　要：运用逻辑分析方法,从社会学、刑法学、体育法学等多维视角探研竞技体育致害行为的正当化及其评定。研究结果表明:社会学理论在评定竞技体育致害行为的正当性上具有理论指导作用;刑法学理论能够用于剔除竞技体育致害行为中不正当的行为;体育法学理论在评定竞技体育致害行为的正当性上依然居于重要核心地位;竞技体育致害行为正当化的其他传统理论存在一定缺陷。竞技体育致害行为根据其与体育法规和法律法规的关系可以划分为正当行为、违规行为、违法行为和犯罪行为四种类型。评定竞技体育致害行为的正当性应构建从运动员技术动作的合理性、合法性、守规性三个维度去考量的思路。Using the method of logical analysis,from multidimensional perspectives of sociology,criminal law,sports law,etc.,this article explored and researched the justification and evaluation of harmful behavior in competitive sports. The results showed that the sociological theory had theoretical guidance in the evaluation of the legitimacy of the harmful behavior in the competitive sports;the theory of criminal law could be used to exclude criminal behavior in discerning the legitimacy of harmful behavior in competitive sports;the theory of sports law played an important role in the evaluation of the legitimacy of harmful behavior in competitive sports;the related traditional theories of competitive sports injury behavior had some defects;according to its relationship with sports laws as well as laws and regulations,the harmful behaviors could be divided into four types:proper behavior,irregularities behavior,illegal behavior and criminal behavior. At the same time it put forward the idea of considering the justification of harmful behaviors from three dimensions of rationality,legitimacy and compliance of the athletes’ technical actions.
