新型审讯关系建构中临床心理学原理的应用

摘　　要：审讯关系是影响审讯成效的重要因素。基于临床心理学视角,从心理学技术和方法应用不足、审讯人的价值中立难以维系、以及被审讯人自愿供述的意愿不强三个方面探讨传统审讯关系的局限性,并且分析临床心理学原理应用于审讯过程的适用性和优越性。最后,从重塑“人本性”审讯思维、重建“合作式”沟通关系和重构“主动式”供述情景等方面提出建构新型审讯关系的路径,以缓解传统“对抗式”审讯关系,促进“软审讯法”的应用。Interrogation relationship is an important factor affecting the effectiveness of interrogation.Based on the perspective of clinical psychology,this paper discusses the limitations of the traditional interrogation relationship from three aspects:insufficient application of psychological techniques and methods,difficulty in maintaining the value neutrality of the interrogators and weak willingness of the interrogators to voluntarily confess,and analyzes the applicability and superiority of the principles of clinical psychology applied to the interrogation process.Finally,from the aspects of remolding the“human nature”interrogation thinking,rebuilding the“cooperative”interrogation relationship and promoting the“active”confession willingness,the paper puts forward the path of building a new interrogation relationship,in order to alleviate the traditional“adversarial”interrogation relationship and promote the application of“soft interrogation method”.
