论国家对公民基本权利的多重保障义务

摘　　要：现代社会是风险社会,国家应承担预防风险的义务。国家应承担保护权利主体在实现基本权利的过程中不受第三人侵害的义务。在紧急状态下,国家应对公民基本权利承担制度保障功能。这三层义务和功能层层递进,形成新时代国家对于公民基本权利保障的制度体系。Modern society is a risk society, and the state should take the responsibility of risk prevention. The State shall bear the obligation to protect the subject of rights from the infringement of the third party in the process of realizing the basic rights. In a state of emergency, the state should undertake the system guarantee function for the basic rights of citizens. These three levels of obligations and functions are progressive layer by layer, forming a new era of national system for the protection of basic rights of citizens.
