宪法视角下环境权之人权属性分析

摘　　要：环境权作为一项基本人权,是公民其他权利保障的前提和基础,宪法作为国家的根本大法,对公民权利的保障具有基础性、根本性的作用,通过宪法对环境权予以法治化的保障是环境权保障的重要手段。宪法视角下的环境权人权属性分析的研究结合国内外环境权保障的法律实践,从宪法保障的角度分析了人权与宪法性权利的关系、环境权的人权属性以及环境权宪法保障面临的问题,最后提出了包括环境权入宪、环境权具体化过程中区别保护等的立法建议。As a basic human right,environmental right is the premise and foundation for the protection of other rights of citizens.The constitution,as the fundamental law of the country,plays a fundamental and fundamental role in the protection of citizens'rights.The constitution under the perspective of environmental right attribute analysis of human rights research combining the legal practice of the environmental right safeguard,both at home and abroad on the basis of an analysis of the constitutional protection of human rights and constitutional rights,human rights attribute of environmental right and the relationship between environmental right constitution guarantees are faced with the problem,finally put forward include environmental rights into the constitution,and protect the environment right in the process of the concrete difference between legislative suggestions.
