摘 要:在当今数字版权时代,区块链技术因具有去中心化、防篡改、数据可靠等特点,在很大程度上能够解决数字音乐版权的确权难、收益难、维权难的问题。但是,它面临诸如无法鉴别数字音乐作品独创性、版权证明效力有限、有关监管体制不健全等法律适用难题。本文通过深入分析探讨这些现存问题,对比借鉴国外的相关先进做法,从技术工具和法律政策两方面提出了数字音乐版权区块链保护的具体措施,以期望促进我国数字音乐版权保护的发展,加快建设法治中国的新征程。In today's digital copyright era,block chain technology,with its features of decentralization,tamper-proof and reliable data,can effectively solve the problems of copyright confi rmation,rewards inequality and copyright protection of digital works.However,it faces such issues as the inability to identify the originality of digital music works,the limited effectiveness of copyright certification,and the unsound regulatory system that do not apply with domestic law.Through in-depth analysis and discussion of these existing problems,this paper puts forward specifi c measures for block chain protection of digital music copyright from two aspects of technical tools and legal policies by comparing and drawing on relevant advanced practices of foreign countries,so as to promote the development of digital music copyright protection in China and speed up the new journey of building China under the rule of law.
