权利保障:基层社会治理的价值向度——基于《叫魂》引发的讨论

摘　　要：孔飞力的《叫魂:1768年中国妖术大恐慌》一书讲述了乾隆年间盛世妖言的故事,意在揭示隐藏在叫魂恐慌背后的时代、政治与社会涵义。微观上看,叫魂案反映了皇权制下维权与维稳的关系失衡。以史鉴今,当前社会治理仍面临着公民维权与政府维稳的价值错位,有必要进一步明晰维权与维稳的关系位阶。即维权与维稳并非此消彼长的关系,两者偏废一方都将使社会陷入合法性危机。“平衡论”有助于重塑两者关系、弥补传统治理模式之不足。但上述仅是学理探讨,要实现真正意义上的基层治理现代化,应从制度层面构建以权利保障为导向的基层社会治理体系,具体可从立法保障、程序整合和三治融合探寻建构路径。Philip Alden Kuhn’s book Soulstealers:the Chinese Sorcery Scare of 1768 tells the story of the sacred words of the Qianlong period,which is intended to reveal the era,political and social meaning hidden behind the panic.From the microscopic point of view,the Soulstealers even reflects the imbalance between the rights and stability of the imperial power system.Learn from history,the current social governance still faces the misplaced value of civil rights protection and government stability.It is necessary to further clarify the relationship between rights protection and stability.That is to say,the maintenance of rights and stability is not a trade-off between the two sides.Both sides will cause the society to fall into a crisis of legitimacy.The“balance theory”helps to reshape the relationship between the two and make up for the shortcomings of the traditional governance model.However,the above is only a theoretical discussion.To realize the modernization of grassroots governance in the true sense,we should construct a grassroots social governance system guided by rights protection from the institutional level.Specifically,we can explore the construction path from legislative guarantee,procedure integration and integration of three governances.
