权利主体视野下民间文艺作品的法律保护

摘　　要：民间文艺作品的法律保护是知识产权法中的一个重要环节,我国对民间文艺作品进行法律保护应明确民间文艺作品的定义与内涵,目前其含义模糊不清,民间文艺作品没能充分纳入知识产权保护体系中。发达国家通过立法来规范并保护民间文学作品及其文化产业的发展,中国更应把握机遇,加强立法保护,在这个过程中应关注民间文艺作品的主体和权利。我国民间文学、民间音乐、民间舞蹈等方面有它们独特的表达方式,民间文艺作品有其特定的权利主体。应顺应时代文化发展潮流,通过立法保护,学习并吸纳世界文化优秀之处,发扬并传承本民族传统文化。The legal protection of the works of folk literature and art intellectual property law is an important link of knowledge. To have legal protection of folk literature and art works, we must be clear the definition of folk literature and art works. It is because the meaning of fuzzy, so the folk literature art works are not included in the protection of intellectual property rights. Developed countries regulate and protect the development of cultural industry, is also one of the developing countries of China should grasp the opportunity. After being clear the definition of folk literature and art, should focus on the main body of folk literature and rights. We should keep up with the trend of the era of cultural development. On the one hand, to learn and absorb the excellent culture, in the world, on the other hand carry forward and inheriting the national traditional culture.
