摘　　要：现有解决国际投资争端的机制在解决"一带一路"投资争端方面存在一定的障碍,由此引发构建福建自贸区投资争端仲裁机制的设想。在仲裁员选任方面,允许沿线国家派出数量相等的仲裁员组成仲裁员名册,以确保仲裁员来源的广泛性;在仲裁规则制定方面,借鉴国际仲裁领域高水平的仲裁规则,力求与国际仲裁发展水平相适应;在仲裁方式方面,充分利用互联网、大数据等现代科技手段,以适应因网络技术快速发展对纠纷解决的新要求;在对外合作方面,注重与国内外仲裁机构合作,学习他人先进经验以不断提升自身水平。The existing mechanisms for resolving international investment disputes have certain obstacles in solving the investment disputes under the background of the Belt and Road Initiative.This led to the idea of establishing an investment dispute arbitration mechanism in the Fujian Free Trade Zone.With regard to the selection of arbitrators,an equal number of arbitrators from the countries along the route are allowed to form an arbitrator roster to ensure the broad source of arbitrators.When formulating arbitration rules,we should refer to high-level arbitration rules in the field of international arbitration and keep pace with the development of international arbitration.In terms of arbitration methods,modern technology such as the Internet and big data should be fully utilized to meet the new requirements for dispute resolution due to the rapid development of Internet.In terms of external cooperation,we should attach importance to cooperation with domestic and foreign arbitration institutions,and learn from the advanced experience of others to continuously improve our level.
