摘　　要：绝版作品是虽在著作权保护期限内但无法从市场正常获取的作品,造成了获取障碍。目前绝版作品获取存在非市场化、市场化和半市场化三种解决方案。我国应该选择非市场化和市场化相结合的解决方案,建立适合国情的绝版作品著作权例外和法定许可制度,促进绝版作品获取。The out-of-print works are works which cannot be obtained from the market during the period of copyright protection,resulting in obstacles to acquisition.At present,there are three solutions to acquire out-of-print works:non-marketization way,marketization way and semi-marketization way.China should choose the solution combined non-marketization way and marketization way.That is to say,we should establish the library copyright exception and legal license system for out-of-print works suitable for the national conditions,and promote the acquisition of out-of-print works.
