摘 要:文章在《土地管理法》刚完成第三次修正的背景下,回顾总结了征地制度改革三轮试点的主要历程及做法、取得的经验与不足。试点中对征地范围、程序、补偿水平及标准、安置方式等方面进行了充分探索,一些做法已成为了相关政策制度在全国实施,同时征地制度改革的外部条件也逐步具备,因此,此次修法在征地范围、程序、补偿安置方面得以突破,下一步新征地制度实施中还需要关注边界明确、补偿水平、争议裁决机制、补偿分配等问题。Under the background of the third amendment of the“Land Management Law”,the paper reviews the main course,practice,experiences and deficiency of the three rounds of reform pilot of land expropriation system.In the pilot project,the scope,procedure,compensation level and standard of land expropriation,resettlement method and other aspects were fully explored.Some practices have become the relevant policies and systems that implemented in the whole country.Meanwhile,the external conditions for the reform of land expropriation system have been gradually in position.Therefore,the amendment has made a breakthrough in the scope,procedure,compensation and resettlement of land expropriation.In the next step,we still need to pay attention to the following issues,such as clear defined boundary,compensation level,dispute adjudication mechanism,compensation distribution in the implementation of new land expropriation system.
