从权力到权利:保障公民体育权利进程中政府职责的错位与调适

摘　　要：运用文献资料、案例分析、逻辑反思等研究方法,分析政府权力行使与公民实现体育权利之间的合理关系,探寻政府在保障公民体育权利进程中的职责问题。研究认为:我国公民体育权利与政府职责之间存在供需错位、权限错位、监管错位和立法错位,亟须通过立法提升公民体育权利,以权力分解调适政府保障职责。建议:在权利至上思维主导下,政府应从理念转型、制度保障、明确责任、加强供给与问责监督等方面多维度、全方位地保障公民体育权利,以期为体育制度改革决策提供理论支持,为公民体育权利保障提供实践参考。Using the research methods of literature,case analysis and logical analysis,this paper analyzes the reasonable relationship between citizens’ rights and the governmental administrative power in the field of sports,and explores the responsibility of the government in the process of protecting citizens’ sports rights. The research shows that there are supply and demand dislocation,authority dislocation,supervision dislocation and legislation dislocation between the citizens’ sports rights and the government’s responsibilities. It is urgent to improve the sports rights of citizens through legislation,and adjust the government’s safeguard responsibilities by power decomposition. Suggestions:under the guidance of the thought of rights first,the government should protect the citizens’ sports rights from many aspects,such as concept transformation,system guarantee,clear responsibility,strengthening supsply and accountability supervision,in order to provide theoretical support for the reform and decision-making of sports system and provide practical reference for the protection of citizens’ sports rights.
