摘　　要：私人飞行的兴起,是通用航空领域的重要现象,更是公民飞行自由权利得以实现的突出表现。从立法导向上看,私人飞行的法律监管在充分考量基于公共利益安全价值的同时,应适时转换视角,关注个体利益的自由价值。在“放管服”改革的推动下,我国通用航空法律监管呈现柔化趋势,但对私人飞行的法律监管改革却未能与之桴鼓相应,究其原因就在于监管制度未成体系、监管模式尚未转变、空域管理相对滞后。所以应当在明晰私人飞行性质的基础上,对私人飞行进行单独规制,落实“放宽事前审定,强化事中事后监管”的要求,加快空域管理改革的步伐,从而建立和完善私人飞行法律监管的顶层设计,以指引其走向法治化,实现公共利益与个体利益之平衡。The rise of private flight is an important phenomenon in the field of general aviation,and it is also a prominent manifestation of the realization of citizens'freedom of flight.From the perspective of legislative orientation,the legal supervision of private flights should take into account the security value based on the public interest,and should change the perspective in a timely manner,paying attention to the free value based on individual interests.Under the impetus of reform,China's general aviation legal supervision has shown a trend of softening,but the legal supervision reform of private flights has not been able to respond to it.The reason is that the regulatory system is not systematic,the regulatory model has not changed,and the airspace management is relatively lagging behind.China should separately regulate private flights on the basis of clarifying the nature of private flights.Moreover,we should implement the requirements of“relaxing pre-examination and strengthening post-event supervision”and speeding up the pace of airspace management reform.In this way,we can establish and improve the top-level design of private flight legal supervision to guide it toward the rule of law and achieve a balance between public interest and individual interests.
