摘　　要：在国际人权公约视野下,家庭是人的自然生活共同体和社会的基本单元,家庭生活是人的基本生活方式,个人生而享有在家庭内与家庭成员正常生活的人权。儿童生存和健康成长离不开家庭,儿童与父母等家庭成员生活在一起是实现生存、成长和创造生命价值的基本保障,儿童家庭生活权是具有根本生命意义的重要人权,应受到宪法和法律的有效保护。From the perspective of international human rights conventions,family is the community of natural life and the basic unit of society.Family life is the basic way of life of human beings.Individuals are born to enjoy the human rights of normal life within the family and family members.Children’s survival is inseparable from their families.Living together with their parents and other family members is the basic guarantee to maintain their overall growth and create life value.Children’s right to family life is an important human right with fundamental life significance,which should be protected.
