摘　　要：“法律人”模式是对法律之中人的形象所作的一种人性预设,内涵具有人性要素、目的要素以及环境要素三个要点。“法律人”模式来源于生活,但又高于生活,是一种理想类型。“法律人”模式建构的必要性,主要体现在形而上层面的现实立法需求与形而下层面的类型化研究需要两个维度。“法律人”模式的演进过程与时空轨迹大体经历了“经济人”模式的崛起与“社会人”模式的反思,正向着“生态人”模式迈进。“法律人”模式的理性构造应重点围绕生态安全价值的实现与建立适应性的环境法律规制体系展开。“法律人”模式对于立法诉求的表达是多元的,但生态文明时代更加需要在立法之中嵌入“生态人”模式所依存的核心价值,回应生态法治实践之诉求。The“legal man”model is a presupposition for the image of people in legal life.The connotation has three main points:humanity,purpose,and environment.The“legal man”model comes from life,but it is higher than life,which is an ideal type.The necessity of the construction of the“legal man”model is mainly reflected in the actual legislative needs at the metaphysical level and the typological research at the metaphysical level requires.The evolution of the“legal man”model has experienced the rise of the“economic man”model and the reflection of the“social person”model,and is now moving towards the“ecological man”model.The rational construction of the“legal man”model should focus on the realization and construction of ecological security values and establish an adaptable regulation system.The“legal man”model is not static,but constantly changing with the changes of the times and the development of departmental law.The“legal man”model has multiple expressions of legislative demands,but the era of ecological civilization needs to embed the core value of the“ecological man”model in legislation.
