摘 要:PPP项目合同公法、私法的双重性质决定了合同争议包括民事争议、行政争议和特殊的民行交叉争议。面对如此复杂的争议,需要的不是民事、行政救济的分立,而是合作,思路上应变“取舍”为“综合”。如果合同产生的是民事/行政争议,则采用对应的民事/行政救济。如果产生的是民行交叉争议,考虑到一元救济既无法解决全部争议,又产生争讼、避讼风险,而分别审理本身难度较大且可能导致缠讼,因此应综合民行争议之关联、权益救济之需求与司法体制之现状,采用合并审理的办法,允许行政附带民事诉讼、民事附带行政诉讼。The dual nature of public law and private law on PPP project contracts determines that contract disputes include civil disputes,administrative disputes and special civil disputes.In the face of such a complex dispute,the need is not the separation of civil and administrative relief,but cooperation.In thinking,"choice"is possibly replaced by"synthesis".If the contract produces a civil administrative cross dispute,civil/administrative remedies are applied.If there is a civil&administrative dispute,the one-yuan relief cannot solve all the disputes and the risk of litigation and avoidance.The trial itself is difficult and may lead to litigation;it is necessary to integrate the relationship between civil and banking disputes,the need for relief of rights and interests and the current situation of the judicial system,and adopt the method of combined trial to allow administrative incidental civil litigation and civil incidental administrative litigation.
