摘　　要：居住证制度中首次明确了流动人口能够享受的正面权利清单,以期通过向持有居住证的流动人口赋权的路径实现流动人口市民化。正面清单的赋权逻辑在于保障流动人口合法权益的公平正义价值基础,将各部门、各地区流动人口权力进行明晰化集成,以及管理模式的惯性。正面清单赋权模式存在的问题是仍然秉持行政权利本位的理念,可能导致赋权重行政审批而轻服务,并且清单中夹杂着"充数"的权利项,无法实质性增进流动人口权利。负面权利清单赋权模式能够改进正面清单的这些缺陷,它放权的思维契合了向流动人口赋权的理念,且有利于激励和监督地方政府向流动人口赋权的过程。构建流动人口权利负面清单则需要明确制定负面清单的主体,界定服务、便利等权利的范围,加强执行、动态调整和监督等方面的清单管理。In the residence permit system,it has been clear about the list of positive rights which the floating population can enjoy for the first time,so as to realize the citizenization of the floating population through the path of empowering the floating population with residence permit.The empowerment logic of the positive rights list lies in the following aspects:the value basis of fairness and justice of protecting the legitimate rights and interests of floating population,the clarity and integration of the rights of floating population in various sectors and regions,and the inertia of management model.The problem with the positive rights list empowerment model is that the government still uphold the idea of administrative power standard,which may lead to put more emphasis on administrative examination and approval than providing services,and the list is mixed with "meaningless" rights,which cannot substantially increase the rights of floating population.The negative rights list empowerment model can improve the defects of the positive one,and it fits the idea of empowering the floating population.To construct the negative rights list of floating population,it is necessary to clear the main body of the negative rights list,define the scope of services,convenience and other rights,and strengthen the management of the list in terms of implementation,dynamic adjustment and supervision.
