摘　　要：宪法审查中一个常被忽视的功能是为政党和政治家可能出现的执政风险提供保险。宪法保险的实践已在不少国家获得成功,通过梳理可以析出3种主要的保险类型。在各国的政治制度发展中每种保险类型均依靠具体的保险措施体现着独特的制度影响。实践中宪法保险的设计常依靠"法律剥离"方法和"安全港"机制得以实现。随着政治情势的变化,基于法经济学的模型,宪法保险本身可能会因其所依附的政治宪法环境、审查实施模式的变化而出现各种效力波动。在当下平衡多元利益群体诉求的过程中,宪法保险的"对话式"理念有助于合宪性审查的完善与拓展。A function is often ignored in the constitutional review,namely,the Constitution’s function of political insurance,which provides the insurance for the possible governance risks of political parties and politicians.The practice of the constitutional insurance has been successful in many countries,from which several insurance subtypes can be summarized.In the political development of different countries,each insurance subtype reveals its unique institutional influence with its detailed insurance measures.In practice,the design of constitutional insurance is often achieved by means of constitutional separation,constitutional safe haven and so on.According to the model of law and economics,the effect of constitutional insurance itself may fluctuate due to the change of political constitutional environment and the implementation mode in the constitutional review.The concept of dialogue in constitutional insurance is conducive to the improvement and expansion of the constitutional review,when balancing the demands of multiple interests.
