摘 要:在推动劳动案件适用督促程序的实践中,不仅应当关注督促程序的自身改造,还需要考量劳动案件这一对象所包含的某些制度上的特殊因素。通过对劳动案件适用督促程序的困境分析与原因分析,提出如下完善意见:一是当事人证明宜采用自由证明式的“证据型”模式;二是程序申请费的标准设立应当以保持与劳动争议案件受理费立法理念与逻辑的同步为遵循;三是建立当事人程序利益平衡观,实现对债务人异议权的有效制约;四是以提高程序衔接效能、兼顾劳动者的程序处分权为导向解决程序衔接中的规则冲突。In the practice of promoting the application of the urging procedure in labor cases,we should not only pay close attention to the self-reformation of the urging procedure that is closely related to it,but also need to consider some special institutional factors included in the object of labor cases.Through the analysis of the predicament and the cause of the application of the urging procedure in labor cases,this paper puts forward the following measures:First,the parties’certification should adopt a free-evidence-based“evidence-type”model;the synchronicity of the idea and logic of the case acceptance fee is followed;the third is to establish a party’s view of the balance of procedural interests and to effectively restrict the debtor’s right of objection;the fourth is to solve the process by improving the effectiveness and taking into account the procedural rights of workers and conflicting rules in convergence.
