我国加入GPA出价谈判:进程、前景及对策  

China’s GPA Accession Negotiations: Progress, Prospects and Countermeasures

摘　　要：2007年年底启动GPA加入谈判后,我国先后提交了7份出价清单,逐步扩大了出价范围。2019年10月提交的第7份出价清单又有重大改进,可推动谈判走向结束,因我国的出价范围已与GPA参加方具有相当可比性,且此次再度大幅修改出价清单展现了我国加入GPA的诚意与尽快完成谈判的意愿,同时相关各方总体上亦希望我国尽快完成谈判。然而,鉴于美欧等GPA参加方一直呼吁我国将更多国企纳入出价清单以及我国一直主张的发展中国家特殊待遇要求难获认同,此次出价恐仍难终结谈判;很可能还需再次改进出价才能结束谈判。建议聘请专业机构评估我国出价、以GPA规则为基础谈判缩小分歧、对出价清单再做最后改进及在BFTA和RTAs中纳入政府采购议题,以尽快结束谈判。In 2007, China initiated its GPA accession negotiations. Since then, 7 market access offers have been submitted to the WTO, gradually expanding the coverage of GPA. In the seventh offer submitted in October 2019, significant improvements have been made again. The submission of this new offer can push China’s accession negotiations forward to completion, because that the current China’s offer is relatively commensurate with other GPA Parties’ coverage, the new offer with comprehensive improvements has shown China’s sincerity and willingness to join the GPA as soon as possible, and the GPA parties generally look forward to China’s early accession. However, China’s accession negotiations may not be completed by submitting the seventh offer, as the GPA Parties, especially the US and the EU, have been calling for significant coverage of state-owned enterprises and it is highly impossible for them to agree China’s claim for special and deferential treatment for developing countries;it is highly likely that it will be needed to further revised the offer before negotiations can be concluded. To speed up China’s GPA accession negotiations, it is suggested to evaluate China’s offer by hiring a professional body, come to a compromise in the negotiation on the basis of the GPA provisions, make the final revisions to the offer and include government procurement chapters into BFTA and RTAs.
