摘　　要：区块链技术可以为智能合约搭建底层技术基础设施,随着区块链技术应用热潮的到来,智能合约的关注度也显著提升。智能合约可以对信用机制进行改造,促进信用价值流动,使其与金融场景具备高度耦合性。但与此同时,也产生了新的治理难题,包括当前智能合约应用推广存在反智化现象、智能合约去中心化特点与金融市场中多元主体集中式管理存在矛盾、金融智能合约的创新应用引发新型风险、不完备合同与合同法治理失灵现象并存等。为提升金融智能合约的应用价值,需要积极推动金融法治改革。建议认清智能合约与法律合约的本质差异、推行监管沙盒匹配智能监管。并厘清政府与市场关系定位,转变监管理念。最后,加强顶层设计开展行业标准化体系建设。Block chain technology can build the underlying technology infrastructure for smart contract.With the arrival of the boom in the application of block chain technology,the attention of smart contract has also increased significantly.Smart contract can transform the credit mechanism,promote the flow of credit value,and make it highly coupled with the financial scenario.But at the same time,new governance problems have arisen.It includes the phenomenon of anti-intellectualization in the application and promotion of smart contract,the contradiction between the decentralized characteristics of smart contract and the centralized management of multiple subjects in the financial market,and the new risks caused by the innovative application of financial smart contract,the phenomenon of incomplete contract and contract law governing failure exists at the same time.In order to enhance the application value of smart intelligence contract,it is necessary to actively promote the reform of financial rule of law.It is suggested that we should recognize the essential difference between smart contract and legal contract,and carry out supervisory sandboxmatching intelligent supervision.In addition,clarify the relationship between the government and the market positioning,change the concept of supervision.Finally,strengthen the top-level design to carry out the construction of industry standardization system.
