摘　　要：随着体育的经济和文化价值日益凸显,体育产业投资活动方兴未艾,相关的投资风险与争端解决问题也随之出现。通过梳理中国海外体育产业投资脉络及特点,认为中国海外投资进程中会面临收购行为引发、东道国法律规制和国内政策调整的法律风险,以及文化和道德风险等,须增强风险防范意识,尽早关注并防范。在此基础上,针对中国海外体育产业投资中出现的体育商事和体育投资争端,提出应采取适当方式(如国际体育商事和国际体育投资仲裁)解决争端,切实保障中国投资者的利益。With the increasing emphasis on the economic and cultural value of sports,investment activities in the sports industry are booming.The situation of China’s overseas investment in sports industry in recent years is studied. It is found out that China’s overseas sports industry investment will be faced with merger-related risks,legal regulation risks of host states,risks of domestic policies change,cultural risks and moral hazard,etc.Hence the appropriate solutions(like CAS or ICSID)are put forward to handle the commercial and investment disputes when Chinese investors participate in overseas sports industry,thus to guarantee the interests of Chinese overseas investors.
