论严格责任原则的影响力——由孙杨案说起

摘　　要：2020年2月28日国际体育仲裁院公布了对孙杨抗检行为的裁决,一时间引起了全国热议。如果仔细观察,会发现从孙杨抗检行为开始到裁决的作出,严格责任原则便一直发挥着作用。世界反兴奋剂领域里的严格责任原则以不考虑运动员主观过错、直接连接违规行为与有责结果的方式解决了该领域里的归责难题,保障了世界反兴奋剂运动的有序进行。同时由于其构造、存在缘由、地位等,严格原则具有极大的影响力。通过观察孙杨案,可以再次理解严格责任原则影响力并发现其中问题。如今在没有可替代的归责原则情况下,需加强规则建设以协调社会价值与个人价值之间的冲突。On February 28th,2020,the Court of Arbitration for Sport announced its ruling on SUN Yang’s anti-inspection behavior,which caused a heated debate in China.If you observe it carefully,you can find that the strict liability principle has been playing a great role from the beginning of SUN Yang’s anti-inspection behavior to the announcement of the CAS decision.The principle of strict liability in the world anti-doping field solves the problem of liability by directly linking the violation behavior and the responsible result without considering the subjective fault of the athletes,guaranteeing the orderly development of the world anti-doping campaign.Meanwhile,due to its structure,reasons for existence and status,the strict liability principle has profound influences.By observing the case of SUN Yang,we can again understand the influence of strict liability principle,and also find out its problems.In the absence of an alternative principle of the strict liability,it is necessary to enhance the building of rules to reconcile the conflicts between social values and individual values.
