我国宽严相济刑事政策研究总态势及知识演化——基于科学知识图谱的可视化分析

摘　　要：为全面直观展示我国宽严相济刑事政策自实行以来的研究成果,为社会治理从组织化调控到制度化规训的转型提供坚实可靠的政策支持,采用科学计量分析和共词分析法,综合运用CiteSpace、Bibexcel软件绘制宽严相济刑事政策研究成果的科学知识图谱,沿着“主题(横)—时间(纵)”两条主线展开研究,结果证明,我国宽严相济刑事政策研究总体态势良好,历经快速发展期、细化发展期、过渡转型期三个阶段,近年主要关注认罪认罚制度试点完善以及多发犯罪的治理。在全面深化司法改革的背景下,宽严相济刑事政策研究的知识树已经基本成型,呈“本体(树干)—方法(树枝)”的二元知识结构。In order to comprehensively and intuitively display the research results of China’s criminal policy of combining strictness with leniency since its implementation,it provides solid and reliable policy support for the transformation of social governance from organized regulation to institutionalized discipline,using scientific measurement analysis and co-word analysis.Comprehensively use CiteSpace and Bibexcel software to draw an atlas of scientific knowledge of the research results of the criminal policy of combining strictness with leniency,and carry out research along the two main lines of“theme(horizontal)-time(vertical)”.The results of the study finds that China’s overall criminal policy of combining strictness with leniency is in good shape.It has gone through three stages of rapid development,detailed development and transitional transformation.In recent years,it has mainly focused on the improvement of the pilot system of pleading guilty and punishment and the governance of multiple crimes.In the context of deepening judicial reforms in China,the knowledge tree of the research on criminal policy of combining strictness with leniency has basically taken shape,showing a dual knowledge structure of“ontology(trunk)-method(branch)”.
