商业银行信用卡领用合同格式条款涉及金融消费者权益保护有关法律问题分析

摘　　要：商业银行普遍采用与金融消费者签订信用卡领用合同方式对持卡人信用卡使用行为进行约束,但合同中格式条款可能存在侵犯消费者合法权益内容:一是当信用卡申领人未依约还款时银行可扣划申领人在本行其他账户的资产,甚至是未到期的定期存款,并按活期计息;二是信用卡到期后,申领人不愿换领新卡的,应于卡片到期前一定时间内电话告知银行,否则视为同意更换新卡。针对该问题,经过对8家资产规模较大、具有行业代表性的国有商业银行、股份制商业银行以及地方法人商业银行(以英文字母代替)调研,发现各类银行均不同程度存在该问题。本文重点就信用卡格式条款涉嫌侵权问题进行研究,进而提出解决对策,以便为督促商业银行规范开展经营业务、强化央行金融消费权益保护履职提供有益借鉴。Commercial banks generally use credit card collection contracts with financial consumers to restrict cardholders'use of credit cards,but the format clauses in the contracts may violate the legitimate rights and interests of consumers:First,when the credit card claimant fails to repay according to the contract,the bank may deduct the claimant's assets in other accounts of the Bank,or even the unexpired time deposit,and calculate the interest based on the current account;The second is that after the credit card expires,the claimant is unwilling to redeem the new card,it should be notified to the bank by phone within a certain period of time before the card expires,otherwise it is deemed to agree to replace the new card.In response to this problem,after investigating 8 state-owned commercial banks,joint-stock commercial banks,and local commercial banks(represented by English letters)with large assets and industry representativeness,it was found that this problem exists in various banks to varying degrees.This article focuses on the study of suspected infringement of credit card format clauses,and then proposes countermeasures in order to provide useful lessons for urging commercial banks to standardize their business operations and strengthen the protection of the central bank's financial consumer rights and duties.
