论伍廷芳对美国国民法律意识的考察--以《美国视察记》为中心

摘　　要：《美国视察记》~①来源于伍廷芳出任清政府出使大臣期间对美国的长期观察,体现了他对美国国民、国家与社会的认识,对美国法律制度的认识有赞同也有批判。文章以该书为核心,并旁及伍廷芳其他著述,重点讨论其对美国国民法律意识的考察。全文围绕着对美国国民权利与义务法律自觉意识及其行为的观察进行问题设定,展示出伍廷芳眼中的美国近代社会镜像以及他所秉持的法律观念。America through the Spectacles of an Oriental Diplomat is derived from Wu Tingfang’s longtermobservation of the United States when he was an envoy of the Qing government, which reflects hisunderstanding of American people, nation and society, including his approval and criticism of American legalsystem. Based on this book and Wu Tingfang’s other works, this paper focuses on his study of American legalconsciousness. The full text revolves around the observation of the legal consciousness and behavior ofAmerican citizens’rights and obligations, showing the mirror image of American society in the eyes of WuTingfang and his legal concept.
