摘　　要：刑事涉案财物先行返还程序是一种特殊的涉案财物处置程序。先行返还程序适用存在的问题包括,出现较大功利考虑、返还条件难以把握以及返还错误时缺乏救济程序等。先行返还程序实为诉讼程序,应在坚持法定、公开、参与和救济等原则的基础上,按照诉讼程序规则的结构要素对其进行完善。此外,还需严控涉案财物保全范围、建立刑事卷宗二元机制和理顺先行返还流程,为先行返还程序适用提供配套措施。The procedures for advance return of criminal case-related property is a special procedure for disposing of the said property.The problems involved with the application of advance return procedures include conflicting utilitarian considerations,difficulties in responding to return conditions,and lack of relief procedures when return errors have happened.The advance return procedure is a litigation procedure.On the basis of adhering to the principles of legality,openness,participation and relief,the advance return procedure should be improved in accordance with the structural elements of the procedural rules.In addition,it is necessary to strictly control the scope of criminal case-related property preservation,establish a dual mechanism for criminal dossiers,and streamline the process of advance return,so as to provide supporting measures for the application of procedures for advance return.
