摘　　要：自休闲农业和乡村旅游战略实施后,全国各地呈现出多样化的休闲农业和乡村旅游发展势态,这对发展我国农村经济、实现乡村振兴起到了助推作用。但是在其发展过程中仍面临现实阻力和法律层面的问题。尤其是在行政监管、土地流转、"一套式服务"合同、家庭共有、侵权行为等方面,还存在法律制度缺憾,急需加以科学有效的法律规制,以实现休闲农业和乡村旅游产业的稳步发展,促进我国社会主义市场经济的繁荣。Since the implementation of the leisure agriculture and rural tourism strategy in China, it has shown a development trend of diversified leisure agriculture and rural tourism nationwide, which has played a catalytic role in developing China’s rural economy and realizing Chinese rural revitalization. However, in the process of its development, there are still practical resistances and legal problems, especially in the aspects such as administrative supervision and management, land transfer,"a set of services"contract, family co-ownership, infringement act, where there are still deficiencies in the legal system. It is urgently needed to have a scientific and effective legal regulation to realize the steady development of leisure agriculture and rural tourist industry and promote the prosperity of China’s socialist market economy.
