传统村落整体性保护的法治基础——写在《文物保护法》修订征集公众意见之际

摘　　要：随着第五批国家级传统村落的名单公布,传统村落保护再次受到各方广泛的关注。保护传统村落应遵循"整体保护"的基本原则,为了加强对传统村落的保护力度,应将整体保护传统村落写入《中华人民共和国文物保护法》中。在《文物保护法》修订征集公众意见之际,笔者建议在《文物保护法》"不可移动文物"章节加入相关法条,列明保护传统村落的整体乡村景观,并建议将《传统村落乡村景观保护条例》的制定工作提上日程。With the publication of the list of the fifth batch of National Traditional Villages,the protection of traditional villages has attracted more and more attention from all walks of life.The protection of traditional villages should follow the basic principle of"overall protection".In order to strengthen the protection of traditional villages,the protection of traditional villages as a whole should be included in the Law of the People's Republic of China on the Protection of Cultural Relics.At the time of collecting public opinions on the revision of the Law on the Protection of Cultural Relics,the author suggests that relevant laws should be added to the section on"immovable cultural relics"of the Law on the Protection of Cultural Relics to specify the overall landscape of traditional villages.
