摘　　要：体育赛事节目的属性及类型决定了其法律保护的基本框架。体育赛事节目的摄制离不开摄制者自由意志支配下的选择、编排。体育赛事节目具有一定程度的独创性,属于《著作权法》意义上的作品。体育赛事节目不属于《著作权法》第3条第6项中的"电影作品和以类似摄制电影的方法创作的作品",也不是第14条中的"汇编作品",而是第3条第9项中的"其他作品"。在此基础上,通过法律解释的方法展开司法保护,才是更为妥当的解决之道。The attribute and type of sports event programs determined the basic framework of legal protection.Some domestic scholars and judges believe that sports event programs contain originality,but it cannot reach the required height,and can only be classified as video recordings.The affirmation of sports event programs that contain originality as video recordings is not only contrary to the jurisprudence and logic,but also unable to find relief basis under the framework of the current law,not to mention inconsistent with the trend of law revision,and unable to provide legal protection for the sports industry.The difference between works and products in The Copyright Law lies in the existence of originality rather than the degree of originality.The production of sports event programs cannot be separated from the selection and arrangement under the control of the free will of the producers.Sports event programs have a certain degree of originality and belong to the works under The Copyright Law.Sports event programs do not belong to"cinematographic works and works created by virtue of an analogous method of film production"in article 3(6)of The Copyright Law,nor are they"works created by compilation"in article 14,but"other works as provided for in laws and administrative regulations"in article 3(9).On this basis,judicial protection through legal interpretation is a more appropriate solution.
