摘 要:我国《著作权法》中广播权与表演权和信息网络传播权存在相互交叉和边界不清的问题。扩音器传播广播的作品的权利,实质上是机械表演权;公开播送作品的表演的权利,实质上是向公众传播权;对作品的网络广播或网络转播并不受广播权控制。建议我国《著作权法》第三次修改重新确立公开表演权和公开传播权的各自范围,完善我国著作权人享有的无形传播权内容。In the Copyright Law of the People’s Republic of China,the scope of the exclusive rights of broadcasting,public performance and making available to the public is overlapping,and the boundaries of them are obscure.The right of public communication by loudspeaker the broadcast of the work is essentially a public performance right;the right of communication to the public of the performance of their works is essentially a right of communication to the public;the online webcasting of a work or simultaneous webcasting of the broadcast is not included in the broadcasting right.It is recommended that,in the third revision of China’s Copyright Law,the respective scopes of the right of public performance and the right of communication to the public shall be reestablished.
