摘 要:从我国应对突发事件和修订《突发事件应对法》的需要出发,有必要对我国应急基本法的结构及其调整问题进行探讨。2007年制定的《突发事件应对法》实施不力的重要原因,是该法设计的应对制度定位高度不够和突发事件应对主体的协调能力有限。根据国家应急法律体系对应急基本法的需求,应当以现有《突发事件应对法》为基础制定统一的《紧急状态法》。在制定统一的国家应急基本法中,应当高度重视常态体制进行应急决策的制度构建和国际合作问题。Based on China’s need to respond to emergencies and revise the Emergency Response Law, it is necessary to discuss the structure and adjustment of the national emergencies basic act. The major reasons for the weak implementation of the "Emergency Response Law" enacted in 2007 are the inadequate positioning of the response system designed by the Law and the limited coordination capacity of the main body of emergency response. According to the national emergency legal system’s requirements for the emergencies basic act, a unified Emergency Law should be formulated based on the existing Emergency Response Law. In formulating a unified national emergency basic act, great attention should be paid to the system construction and international cooperation of emergency decision-making with the normal system.
