从一轨到双轨——论分类管理背景下司法行政人员补充机制的完善

摘　　要：现行司法行政人员补充主要依靠两种方式:一是选任或招录具有法律职业资格或审判经验人员;二是根据岗位需求招录非法学专业人员,包括定岗招录、军转干部接收和干部遴选。但随着人员分类改革逐步推进,司法行政岗位吸引力降低导致现行司法行政人员补充后续乏力,人员补充机制不尽完善也导致工作效果不佳,埋下影响司法公正的隐患。为解决司法行政人员补充难题,文章引入职位管理理论,厘定司法行政职位设置,根据职位设置下的任职条件分析选择相应人员补充模式,进而根据岗位个性化需要构建司法行政人员补充双轨制。提出相关建议克服现行人员补充模式的不足,实现司法行政人员补充的机制优化,为新一轮司法改革持续深入筑好基石。The current judicial administrative personnel recruitment mainly relies on two ways:one is to select or recruit persons with legal professional qualifications or trial experience;the other is to recruit illegal professionals according to the needs of the post,including the recruitment of selected posts,the acceptance of cadres transferred from the army and the selection of cadres.However,with the gradual advance of the personnel classification reform,the reduction of the attractiveness of judicial administrative posts has led to the weak follow-up of the current recruitment of judicial administrative personnel,and the imperfect recruitment mechanism has also led to poor work results,forming the hidden danger which affects the judicial justice.In order to solve the problem of judicial administrative staff recruitment,this paper introduces the position management theory,determines the judicial administrative position setting,and selects the corresponding personnel recruitment mode according to the analysis of the post conditions under the position setting,and then constructs the personnel supplement double-track system according to the judicial administration post individuation needs.This paper tries to put forward some suggestions to overcome the deficiency of the current mode of personnel recruitment,to optimize the mechanism of personnel recruitment of judicial administration,and to build a good foundation for the new round of judicial reform.
