论创建微信群组织抢红包赌博行为之定性

摘　　要：创建微信群组组织发红包赌博的行为是构成开设赌场罪还是赌博罪,司法实践中存在重大争议,同案不同判现象时有发生。网络空间可以设立赌场已得到规范与学理上的承认,微信群与网站具有相同功能,可以将网站作为微信群的上位概念。以最高人民法院指导案例为代表现象归纳型区分方式很难达成一致意见,开设赌场罪与聚众赌博型赌博罪的区分应采取实质标准--危险源中心说,即将能向不特定人不断发送诱惑性的危险信息、处于引诱他人实施违法行为之危险源地位的创建微信群组织赌博行为,定性为开设赌场罪。指导案例总结的"以营利为目的"与"一段时间内持续组织"特征不是区分两罪的形式标准,"邀请人员"与"进行管理控制"可以成为区分两罪的形式标准。Whether the act of creating WeChat group for red envelopegambling constitutes the crime of setting up casinos or a gambling crime is a major controversy in judicial practice,and different judicial determinations occurred.The establishment of casinos in cyberspace has been recognized in terms of norms and theories.WeChat group has the same function as the website,and the website can be regarded as the superordinate concept of WeChat group.The method of induction and differentiation represented by guidance case of the Supreme Court fails to reach an agreement.The crime of setting up casinos should be distinguished from a gambling crime on the substance standard--theory of hazard center,that is,such behaviors will be determined as the crime of setting up casinos:being able to randomly and continuously send people dangerous seducing information,behaviors of organizing gambling through the establishment of WeChat by those who are in the hazard center of seducing others to implement the illegal behavior.The"being profit-oriented"and"continuous organization over a period of time"in the guidance case are not the formal standards to distinguish the two crimes,instead"inviting others"and"carrying out management control"are.
