摘  要:教育考试成绩异议申诉本质上是一种行政性的非诉讼程序,是参加考试的考生及其利益相关者向考试机构或考试组织管理者,就考试结果提出复查、复核要求的权益救济行为。以高考为代表的我国教育考试的成绩异议申诉机制还需进一步完善,主要存在成绩复核主体责任有待明确、对成绩复核行为的专业性缺乏心理认同、考生行使申诉权缺乏边界意识等问题。建议教育行政部门厘清责任主体,成立成绩复核专家委员会;完善法律法规,规范成绩复核相关行为;主动正面宣传,引导考生正当行使合法权利,从而确保我国教育考试成绩异议申诉机制畅通有序。The appeal of educational examination score objection is essentially a kind of administrative non-litigation procedure,which is a kind of right remedy behavior that examinees and their stakeholders ask examination institutions or examination organization managers to recheck the examination results.The appeal mechanism of the educational examination’s result objection in China needs to be further improved.Problems are that the main responsibility of the performance review needs to be clarified,the professional nature of the performance review lacks of psychological recognition,and the examinees needs to set up of boundary awareness in exercising the right of appeal.It is suggested that the education administrative departments should clarify the main body of responsibility,establish an expert committee for performance review,perfect laws and regulations,standardize the relevant behavior of performance review,actively and positively publicize and guide the legitimate rights of examinees to be exercised properly,so as to ensure the appeal mechanism of educational examination scores in China to work effectively and efficiently.
