警察使用枪支防卫法律问题研究

摘　　要：面对日益复杂的社会治安形势,警察使用枪支防卫的权力既应受到制约,又需予以保障,现行相关立法尚存在一定的不足,亟待完善。论证了警察使用枪支防卫的性质,阐述了警察使用枪支防卫应当在比例原则与最大保护原则之间寻求平衡。针对实践中存在的法律依据层级低、使用条件指导性不强、使用枪支个人防卫规定阙如等突出问题,提出了通过制定"人民警察警械和武器使用法"明确警察使用枪支防卫性质、下发法规案例汇编供民警参阅、明确警察使用枪支进行个人防卫的合法性等建议,以期对我国警察使用枪支防卫制度的健全有所裨益。Faced with the inereasingly complicated social security situation,the police's power to use firearms should be restricted and at the same time guaranteed.The current relevant legislation still has certain shortcomings and needs to be improved.This article demonstrates the nature of police use of firearms defense and stales that efforts should be made to seek a balance between the principle of proportionality and the principle of maximum protectionin police use of firearms defense.Targeting at such prominent problems as few legal basis in practice,weak guidance on conditions of use,and insufficient regulations on the use of firearms for personal defense,this article proposes such measures as promulgaing the People's Police Arms and Weapons Use Laso to elarify the nature of police use of firearmns,ising the compilation of laws and regulations for the police's reference,and clarifying the legality of po-lice's use of firearms for personal defense so as to benefit the soundness of the police's use of firearms in China.
